General terms and conditions

§ 1 Scope of validity
The following General Terms and Conditions shall apply to the business relationship between Ultra Gloss GmbH (hereinafter: Seller) and the Customer.

§ 2 Reservation of non-availability
We reserve the right to refrain from fulfilling your order if we do not have the ordered goods in stock. In this case, we will inform you immediately about the unavailability and refund any purchase price already paid by you without delay.

§ 3 Return shipping costs
In the event of a revocation, you must bear the regular costs of the return shipment.

§ 4 Retention
The Purchaser shall only be entitled to exercise a right of retention to the extent that its counterclaim is based on the same contractual relationship.

§ 5 Reservation of ownership
Until complete fulfillment of the purchase price claim by the purchaser, the delivered goods remain the property of the seller.

§ 6 Warranty
If there is a defect in the purchased item, the statutory warranty provisions of §§ 434 ff. BGB (GERMAN CIVIL CODE).

§ 7 Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship shall be the court responsible for our registered office (Heilbronn).

§ 8 Delivery and shipping costs
Force majeure of any kind that prevents us in whole or in part from fulfilling our obligations or makes them substantially more difficult shall entitle the Seller to postpone the delivery for the duration of the prevention or to withdraw from the contract in whole or in part to the exclusion of the Buyer's claims for damages against the Seller.

§ 9 Prices and transport insurance
The online shop prices are binding sales prices including statutory VAT. Our shipments are insured against transport risks up to a sum of EUR 500.
